Tylor Swift released a new album in December 2020, named Evermore. US theme park Evermore claims that the singer has used the name of their park that is the infringement.
Evermore was the trademark of the park, as the owner claims, and using the same name for the album had created a confusion. People are thinking if both are linked.
The claims have been made after a noticeable diversion of traffic from Evermore’s website. This manifested decline in traffic from “typical levels” was noticed by Utah venue in a week after the release of the album.
The owner wrote a letter to court making a claim that using the same name has caused Theme park a trouble.
In response to the claim, Taylor Swift’s lawyer has written in return that the name caused no actual damage to the theme park rather it has been in the support. It is great for the marketing and popularity of the theme park. The release of album and searching its name on internet will benefit the client rather than a trouble. It is therefore said that there is “no basis” of the claim.
It was also called “frivolous and irresponsible” by the client and the claim has been discouraged.
In compensation, the owner of Evenmorehas asked for a big amount. They are seeking a damage to the trademark in millions of dollars. They are insistent that the name belongs to the park; the singer has violated the infringement of the copyrights of the trademark by selling the products related to the album.
They say that they have worked hard in conceiving of the name in 2014 and construction of trademark in 2018. They ask to pay for the damage as they have spent millions on the theme park to make it a name and recognized. Theme park has fantasy characters performing live, as main attraction.
This case has been filled in the District Court Utah. The owners are also open to the discussion in order to decide a middle way to settle the issue. They are ready to agree upon some reasonable terms for the discontinuation of name.
The singer has also rejected the claims calling them baseless.
The album has Swift’s 2nd surprise album of the last year that she labelled as sister to Folklore, releases in July. Both sisters were a big success winning the hearts of people and critics. These were also a commercial hit in US and UK.
